Why you cannot swim with dolphins here

The dolphins in Sarasota Bay, Anna Maria Sound and the Gulf of Mexico are wild animals living free. Under the Marine Mammal Protection Act, touching, feeding, chasing or swimming with them is a federal offence. The law carries both civil penalties (fines) and criminal penalties (jail time). Feeding wild dolphins is particularly dangerous to the animals themselves — it teaches them to approach boats and is a leading cause of injury and death.

NOAA Fisheries asks boaters and swimmers to stay at least 50 yards from wild dolphins and never feed them. That distance translates to: if the dolphin looks close enough to touch, you are already breaking the law.

What happens if you interact with a dolphin

Touching, feeding or chasing a wild dolphin can result in federal fines (civil enforcement can exceed $10,000) or criminal charges. If you feed a dolphin or allow it to take food from your hand, you are committing a federal offence. The law applies equally to accidental contact and deliberate pursuit.

The animals also suffer. Dolphins that lose their natural wariness and approach boats are injured more often, entangle more often in fishing gear, and die younger.

Captive swim programmes in Florida

If swimming with dolphins is your main goal, swim programmes exist at theme parks and marine facilities in central Florida and in the Florida Keys. What the three in-water tours actually offer

Three of the eight trips here put you in the water, but never with the animals. The sandbar excursion swims at shallow sandbars where dolphins may pass in the distance. Each one is a chance to be on the water where wildlife happens to pass, not to interact with the animals.

A boat trip puts a captain on the water who knows these flats. He cuts the engine when dolphins appear and uses his distance and local knowledge to position you to see them — without pursuing, without feeding, and well inside the federal boundary.
